Code of Conduct 

To ensure the best possible experience for all site participants and to avoid legal liability, participants are asked to observe some basic guidelines for participation.

By using the site, you agree that you have read and will follow the rules and guidelines set for these discussion groups. This is a great medium with which to solicit the advice of your peers, benefit from their experience, and participate in an ongoing conversation. In order to preserve a climate that encourages both civil and fruitful dialogue in a lawful manner, PLA reserves the right to suspend or terminate participation on all lists for members who violate these rules.

The Rules

  • Don't challenge or attack others. The discussions on the lists are meant to stimulate conversation not to create contention. Let others have their say, just as you may
  • Use caution when discussing products or business practices. Information posted on the lists is available for all to see, and comments are subject to libel, slander, and antitrust laws.
  • All defamatory, abusive, profane, threatening, offensive, or illegal materials are strictly prohibited. Do not post anything in a message on the site that you would not want the world to see or that you would not want anyone to know came from you.
  • Please note carefully all items listed in the disclaimer and legal rules below, particularly regarding the copyright ownership, defamation, and antitrust concerns of information posted to the list.

PLA disclaims all warranties with regard to information posted on this site, whether posted by PLA or any third party. This disclaimer includes all implied warranties of merchantability and fitness. In no event shall CMA be liable for any special, indirect, or consequential damages or any damages whatsoever resulting from loss of use, data, or profits arising out of or in connection with the use or performance of any information posted on this site.

You are responsible for any consequences resulting from your postings, whether intended or unintended.

Do not post any defamatory, abusive, profane, threatening, offensive, or illegal materials. Do not post any information or other material protected by copyright without the permission of the copyright owner. By posting material, the posting party warrants and represents that he or she owns the copyright with respect to such material or has received permission from the copyright owner. In addition, the posting party grants PLA and users of this list the nonexclusive right and license to display, copy, publish, distribute, transmit, print, and use such information or other material.

Basic Antitrust Rules. Messages should not be posted if they might be construed as encouraging or facilitating members in arriving at any agreement that either expressly or by implication leads to price fixing, a boycott of another's business, or other conduct intended to illegally restrict free trade. Messages that encourage or facilitate an agreement about the following subjects are inappropriate: • prices; 
• discounts, or terms or conditions of sale; • salaries; • profits; • profit margins, or cost data; • market shares; • sales territories, or markets; • allocation of customers or territories; or • selection, rejection, or termination of customers or suppliers.

Any discussion that might be viewed by enforcement authorities as leading to increased prices or even minimizing discounts, gifts or promotions are problematic. Even perfectly innocent discussions asking what fees (amount) physicians charge for particular services or comments that just praise or denounce the pricing and business practices of others could be construed as a conversation intended to "encourage" or "facilitate" a conspiracy (agreement) to "fix prices," encourage a "boycott" or otherwise "illegally restrict trade."

The penalties for violating federal antitrust laws are severe. The maximum criminal penalty for violating the Sherman Act is $1 million for an individual and from $10 to 100 million for a corporation (including associations). Under sentencing guidelines, alternative maximum fines can be imposed of up to double the monetary gain realized by the offender or twice the loss to another person.  For these reasons, extreme caution must be exercised on the site to avoid further antitrust challenges.

Individually Identifiable Patient Information
The Health Insurance Portability and Accountability Act ("HIPAA") and its implementing regulations protect the privacy, confidentiality and security of a patient's health information.  It is the strict policy of PLA and this site that no one shall at any time post, disclose, reveal or discuss a patient's individually identifiable health information or protected health information (as such terms are defined by HIPAA and its implementing regulations.)

PLA does not actively monitor the site for inappropriate postings and does not on its own undertake editorial control of postings.  However, in the event that any inappropriate posting is brought to the attention of PLA, we will take appropriate action.  PLA reserves the right to terminate access to any user who does not abide by these rules and guidelines.

Privacy Policy

We respect your privacy. Any personal information you provide to us including and similar to your name, address, telephone number and e-mail address will not be released, sold, or rented to any entities or individuals outside of our organization except as noted below.

We are not responsible for the content of external internet sites. You are advised to read the privacy policy of external sites before disclosing any personal information.


A "cookie" is a small data text file that is placed in your browser and allows us to recognize you each time you visit this site (personalization, etc). Cookies themselves do not contain any personal information, and we do not use cookies to collect personal information. Cookies may also be used by 3rd party content providers such as newsfeeds.
